1. By clicking on "Submit", you instruct Michelin Tyre Plc ("Michelin") to obtain a non-binding offer from a suitable tyre dealer for the selection of Michelin products you have made. Michelin only acts as an intermediary between you and the tyre dealer. The tyre dealer suggested by Michelin does not have a binding effect on you. You are aware that the offer made is subject to change and non-binding; between obtaining the non-binding offer and the conclusion of the purchase between you and the respective tyre dealer, there may be deviations in the commercial framework conditions (e.g. price, delivery conditions, etc.). The final negotiation and agreement of the terms and conditions of sale for the Michelin products included in your selection will take place exclusively between you and the relevant tyre retailer.
2. By clicking on "Submit", you also agree that Michelin may collect and process the data entered by you in the context of the selection made by you in order to process the order – in particular in connection with obtaining the non-binding offer – and in particular to pass it on to the tyre dealer who prepared the non-binding offer; depending on your entries, this data may be personal data within the meaning of the applicable data protection laws.
3. Michelin's liability in the context of the contractual relationship is excluded except in the case of intent or gross negligence. This also applies in the case of the use of Michelin's vicarious agents or vicarious agents. Under no circumstances will Michelin be liable for any indirect or consequential damages, such as loss of profits.
4. The Michelin Standard Conditions of Sale for the replacement business (new tyres, retreading, services and purchase of carcasses) in their current version shall also apply. These are available upon request.
Michelin collects and processes personal data for the purpose of processing the order placed by you to obtain a non-binding offer from a tyre dealer. The personal data collected and processed for this purpose will be stored for a minimum of 12 months. This does not apply to data that is stored as evidence within the framework of statutory retention periods. Their use is reserved for Michelin employees and/or service providers contracted by Michelin. One of these service providers is based in the United States. In order to be able to guarantee sufficient security with regard to data protection, the standard data protection clauses issued by the European Commission have been agreed.
